SDN Share (pilot)

Eligibility

1. Contributors may participate on an individual basis ("Participants") provided that Participant's employer does not oppose such individual participation and the receipt by the employee of an award under the Program. Enrollment into the Program will be at the discretion of Sun.
2. Each Participant is responsible for compliance with his/her employer's policies regarding the receipt of promotional items.
3. Participant represents and warrants that Participant has been granted the authority and permission by his/her employer to participate in this Program.
4. Employees of Sun Microsystems, Inc. and its affiliates, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible to accrue SDN Share Points and earn rewards but are welcome to submit content.
5. Government employees are not eligible to accrue SDN Share Points and earn rewards but are welcome to submit content.
6. Participation in the Program constitutes Participant's and their employer's full and unconditional agreement to these terms and conditions.
7. Rewards cannot be shipped to certain embargoed countries.

Modification and Termination of the Program

1. Sun reserves the right to modify any of the terms and conditions set forth herein - including, but not limited to, the duration of the Program Period, at any time, with or without notice, even though these changes may affect a Participant's ability to accrue or use his/her SDN Share Points.
2. Participant's continued participation in the Program constitutes the Participant's acceptance of any changes to these terms and conditions. Participants are responsible for remaining knowledgeable as to any changes that Sun may make to these terms and conditions. The most current version will be available here and will supersede all previous versions.

General Terms and Conditions

1. The Program is subject to all local laws and regulations and is void where prohibited by law.
2. Sun reserves the right to discontinue the participation privileges of any Participant who engages in any fraudulent activity or uses the Program in a manner inconsistent with these terms and conditions or any federal or state laws, statutes or ordinances. Discontinued participation privileges may result in the loss of all accumulated SDN Share Points and benefits. In addition to discontinuance of participation privileges, Sun shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary in its sole discretion.
3. Any attempt by any person to undermine the legitimate operation of the Program through fraud or any other means may be a violation of criminal and civil law, and, should such an attempt be made, Sun reserves the right to seek damages from any such person to the fullest extent permitted by law. Sun's failure to enforce any of these terms and conditions shall not constitute a waiver of that, or any other, provision.
4. SDN Share Points do not constitute property of a Participant and may be revoked by Sun at any time as set forth herein. SDN Share Points may be not transferred, sold, or assigned, and are not transferable upon death, as part of a domestic relations matter or otherwise by operation of law.
5. Sun is not responsible for any incorrect or inaccurate information supplied by Participants while participating in the Program.
6. All questions or disputes regarding eligibility for the Program, whether SDN Share Points can be earned or redeemed, or a Participant's compliance with these Terms and Conditions, will be resolved by Sun in its sole discretion.
7. Every 6 months from the start of the Program Period, the member's account will be cashed out for the vested SDN Share Points they have earned. Sun will notify the member of the reward level they have earned and automatically send the reward via electronic mail in 4-6 weeks. Any remaining balance carries over to the next 6 month period. Non-vested SDN Share Points will be also rolled over into the next 6 month period.

Limitation of Liability

1. If Sun improperly denies a Participant any SDN Share Points or a Reward, Sun's entire liability and Participant's sole and exclusive remedy will be limited to a distribution of the equivalent amount of SDN Share or the Reward as set forth above. By participating in the Program, a Participant waives any and all rights to bring any claim or action related to such matters in any forum beyond one (1) year after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based.
2. To the fullest extent allowable by law, Sun specifically disclaims any representations or warranties, express or implied, regarding the Rewards, including any implied warranty of merchantability or fitness for a particular purpose and implied warranties arising from course of dealing or course of performance. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
3. Sun Microsystems does not personally verify or endorse the content that is submitted. Sun Microsystems is not responsible for the use of any content that is submitted nor does Sun guarantee that the content is legally sharable, virus free, or free of errors.

Privacy

1. Sun Microsystems, Inc. respects your desire for privacy. Personal information collected from this form will not be shared with organizations external to Sun without your consent, except to process data on Sun's behalf in connection with this transaction. We will use your personal information for communications regarding your account. Sun, as a global company, may transfer your personal information to countries which may not provide an adequate level of protection. Sun, however, is committed to providing a suitable and consistent level of protection for your personal information regardless of the country in which it resides.
