SDN Share

Eligibility

1. Only SDN members can submit content, earn SDN Share Points, and vote. Everyone, however, can view the content.
2. Contributors may participate on an individual basis ("Participants") provided that Participant's employer does not oppose such individual participation. Enrollment into the Program will be at the discretion of Sun.
3. Participant represents and warrants that Participant has been granted the authority and permission by his/her employer to participate in this Program.
4. Participation in the Program constitutes Participant's and their employer's full and unconditional agreement to these terms and conditions.

Modification and Termination of the Program

1. Sun reserves the right to modify any of the terms and conditions set forth herein - including, but not limited to, the duration of the Program Period, at any time, with or without notice.
2. Participant's continued participation in the Program constitutes the Participant's acceptance of any changes to these terms and conditions. Participants are responsible for remaining knowledgeable as to any changes that Sun may make to these terms and conditions. The most current version will be available here and will supersede all previous versions.

General Terms and Conditions

1. The Program is subject to all local laws and regulations and is void where prohibited by law.
2. Sun reserves the right to discontinue the participation privileges of any Participant who engages in any fraudulent activity or uses the Program in a manner inconsistent with these terms and conditions or any federal or state laws, statutes or ordinances. In addition to discontinuance of participation privileges, Sun shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary in its sole discretion.
3. Any attempt by any person to undermine the legitimate operation of the Program through fraud or any other means may be a violation of criminal and civil law, and, should such an attempt be made, Sun reserves the right to seek damages from any such person to the fullest extent permitted by law. Sun's failure to enforce any of these terms and conditions shall not constitute a waiver of that, or any other, provision.
4. Sun is not responsible for any incorrect or inaccurate information supplied by Participants while participating in the Program.
5. All questions or disputes regarding eligibility for the Program or a Participant's compliance with these Terms and Conditions, will be resolved by Sun in its sole discretion.

Limitation of Liability

Sun Microsystems does not personally verify or endorse the content that is submitted. Sun Microsystems is not responsible for the use of any content that is submitted nor does Sun guarantee that the content is legally sharable, virus free, or free of errors.

If Sun improperly denies a Participant any SDN Share Points or a Reward, Sun's entire liability and Participant's sole and exclusive remedy will be limited to a distribution of the equivalent amount of SDN Share or the Reward as set forth above. By participating in the Program, a Participant waives any and all rights to bring any claim or action related to such matters in any forum beyond one (1) year after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based.

To the fullest extent allowable by law, Sun specifically disclaims any representations or warranties, express or implied, regarding the Rewards, including any implied warranty of merchantability or fitness for a particular purpose and implied warranties arising from course of dealing or course of performance. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

SDN Share Code of Conduct

Welcome to the SDN Share. By using this Website and the Services provided on it, You certify that You have read and agree to abide by Sun Microsystems, Inc's Terms of Use agreement, which applies to all areas of the Sun.com Website including SDN Share, and this Code of Conduct, which outlines and highlights the conduct expected of participants in SDN Share.

While Sun reserves the right to edit or remove any Content, in the spirit of keeping SDN Share a place to share valuable information, Sun generally intends to remove or edit only Content we determine to be harmful or offensive or to violate our Restrictions. Sun will operate SDN Share through moderators who work for Sun and input from the SDN Share Community. Please use the same common courtesy in SDN Share as You would in any other public place. People use this resource as a place to share and gather information about developing programs for Sun technologies.

See the Sun Terms of Use, Section 2, Your Obligations and Conduct, for basic rules of conduct. The following additional code is also applicable to Your participation in the SDN Share Program. A few capitalized terms are defined in section 1.6 below; other capitalized terms are defined in the Terms of Use.

Code of Conduct

1. Sun is not responsible for any Content that users post in the SDNShare program.
   You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that You, and not Sun, are entirely responsible for all Content that You upload, post or otherwise transmit via the Services. Sun does not control the Content posted via the Services and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Services, You may be exposed to Content that is offensive, indecent or Objectionable.
2. There is no place in the submitted posts or comments area for slander, third-party commercial advertisements (including links) or unauthorized information disclosure.
   While it is not our intent to monitor Your online communications, Sun reserves the right to edit or remove any Content, including Content that we determine to be harmful, offensive or otherwise in violation of the Terms of Use or this Code of Conduct. Sun and the SDN Share Community may also remove Content that contains third-party commercial advertisements, is inaccurate or includes unauthorized disclosure of personal information. Violation of the Restrictions as defined below ) may also result in the termination or suspension of Your account. These Restrictions apply to all Content provided to or through the Services, including but not limited to email messages, newsgroup postings, chat and personal or business web pages.
3. You agree, if asked by a representative of Sun or the SDN Share Community to cease posting any Content, and/or links to Content, deemed offensive, Objectionable, or in poor taste by Sun or the SDN Share Community. Any personal attacks will be removed and can be grounds for banning.
   You agree not to post or store on Sun.com or any of its affiliated sites any Content that violates or infringes anyone's intellectual property rights (including copyrights, trademarks, trade secrets, patents, publicity rights or (to the extent protect able) confidential ideas. You agree not to use inaccurate, harmful, obscene, defamatory, racist, violent, offensive, lewd, lascivious, filthy, harassing or otherwise objectionable ("Objectionable") Content on the Forums websites, or to post or store any Objectionable Content on Sun.com or any of its affiliated sites. Sun reserves the right to delete the accounts of users who do not comply with these requirements.
4. You agree that You will not use the Website to: (a) transmit spam, bulk or unsolicited communications; (b) pretend to be Sun or someone else, or spoof Sun's or someone else's identity; (c) forge headers or otherwise manipulate identifiers (including URLs) in order to disguise the origin of any Content transmitted through the Services; (d) misrepresent your affiliation with a person or entity; (e) disrupt the normal flow of dialog or otherwise act in a manner that negatively affects other users' ability to use the Website; (f) engage in activities that would violate any fiduciary relationship, any applicable local, state, national or international law, or any regulations having the force of law, including but not limited to attempting to compromise the security of any networked account or site, operating an illegal lottery or gambling operation, stalking, or making threats of harm; or (g) collect or store personal data about other users unless specifically authorized by such users.
5. Definitions
   "Objectionable" describes Content that Sun acting directly or the SDN Share Community deems offensive, indecent, inaccurate, harmful, obscene, defamatory, racist, violent, offensive, lewd, lascivious, filthy, harassing or otherwise objectionable.
   
   "Restrictions" means Sun's restrictions against Content that (a) Sun acting directly or through the SDN Share Community deems potentially slanderous, libelous or defamatory, harmful, offensive, inaccurate or otherwise Objectionable ; (b) includes third party advertising or unauthorized disclosures of personal information; (c) violates or infringes anyone's intellectual property rights (including copyrights, trademarks, trade secrets, patents, publicity rights or (to the extent protect able) confidential ideas); or (d) otherwise violates the Terms or this Code.
